1. Scope of Application
These General Terms and Conditions apply to the use of the website international-festival-ballet.de (hereinafter “Website”), operated by:
Ovation Events GmbH
Staudacher Str. 3a
81825 Munich, Germany
Represented by: Irena Veresh
2. Service Description
Through the Website, we provide information about ballet performances of the International Festival Ballet tour production (dates, venues, ballet programs). Actual ticket sales do not take place via our Website, but exclusively through external ticketing partners linked on the respective event page. Depending on the country and venue, these include inter-regional providers such as Eventim, Ticketmaster, Ticketcorner or oeticket as well as the respective venue itself or its local ticket pre-sales (e.g. concert halls, theaters, cultural centers). Since the providers used may change with each new tour date, no final list is maintained here; the provider linked as “Buy Tickets” on the respective event page is always decisive. When clicking on this link, the user is redirected to the website of the respective third-party provider.
3. Contracting Party for Ticket Purchase
The purchase contract for a ticket is concluded exclusively between the user and the respective external ticketing partner. For prices, payment processing, cancellation, exchange, refund and all rights and obligations associated with the ticket purchase, only the terms and conditions and cancellation information of the respective third-party provider apply. Ovation Events GmbH is not involved in this contractual relationship and assumes no warranty or liability for it.
4. Use of the Website
The contents of the Website are intended exclusively for information about the performances. Commercial reuse, reproduction or editing of texts, images or other contents of the Website requires prior written consent from Ovation Events GmbH, unless statutory exceptions (e.g. right of quotation) apply.
5. Changes to Dates and Programs
Dates, venues, casts and programs may change at short notice. Ovation Events GmbH endeavors to keep the Website up to date at all times, but assumes no liability for the accuracy, completeness and timeliness of the published information. The information provided by the respective ticket provider or venue is always decisive for details about the specific event.
6. Liability
Ovation Events GmbH is liable without limitation for intent and gross negligence as well as under the provisions of the Product Liability Act. For slight negligence, Ovation Events GmbH is only liable for breach of an essential contractual obligation (cardinal obligation) and is limited to the foreseeable, contract-typical damage. Otherwise, liability for slightly negligent breaches of duty is excluded. The above liability limitations do not apply to violations of life, body or health.
7. External Links
The Website contains links to websites of third parties (ticketing partners and venues, social networks). Ovation Events GmbH has no influence over the contents of these external websites; no warranty is assumed for their contents. The respective provider of the linked pages is always decisive.
8. Applicable Law and Jurisdiction
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the country in which the user has his or her habitual residence remain unaffected. The place of jurisdiction for disputes with entrepreneurs is Munich.
9. Dispute Resolution
Ovation Events GmbH is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body (§ 36, § 37 VSBG).
10. Final Provisions
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
